Terms of Service

Welcome to PM Solutions Hub. These Terms of Service ("Terms") govern your access to and use of our website, services, and software ("Services"). By creating an account, signing up for a service plan, or otherwise using our Services, you agree to be bound by these Terms.

1. Description of Service

PM Solutions Hub provides an AI-powered lead-response platform for roofing contractors. Services include but are not limited to:

  • 60-second AI voice response to form-submitted leads
  • Multi-step automated follow-up sequences (calls + SMS)
  • 24/7 inbound AI assistant line
  • Dedicated phone number provisioning
  • Client portal access (Pro plan)
  • AI roofing estimator (Pro plan)
  • Website lead-capture widgets (Pro plan)
  • Real-time storm tracking and pipeline analytics (Pro plan)

2. Eligibility

You must be at least 18 years old and authorized to enter into contracts on behalf of your business to use our Services. Services are intended for legitimate roofing-related businesses operating in the United States.

3. Account Registration

To access certain Services, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized access.

4. Service Plans, Billing, and Setup Fees

We offer two primary service plans:

  • Starter: $1,399 per month + $500 one-time setup fee
  • Pro: $2,099 per month + $850 one-time setup fee

Pricing is subject to change with 30 days' advance notice to existing clients. Setup fees are non-refundable once onboarding work has begun. Monthly subscription fees are billed in advance on the same day each month and are non-refundable except as required by law. Promotional offers (such as first-month-free trials) are subject to the terms specified at the time of the offer.

5. Cancellation

Service plans are month-to-month with no long-term contract. You may cancel at any time by emailing pierce@pmsolutionshub.com with at least 7 days' notice before your next billing date. Cancellation takes effect at the end of your current billing period. Already-paid fees are non-refundable. We reserve the right to suspend or terminate Services for non-payment, abuse, or violation of these Terms.

6. Acceptable Use

You agree not to use the Services to:

  • Violate any applicable law, regulation, or third-party right (including TCPA, telemarketing rules, and SMS consent requirements).
  • Send unsolicited messages or spam to leads who have not consented to communication.
  • Impersonate any person or entity, or misrepresent your affiliation.
  • Interfere with, disrupt, or attempt to reverse-engineer the Services.
  • Use the Services for any business outside the scope of legitimate roofing or home-improvement services without prior written approval.
  • Resell, sublicense, or white-label the Services without a separate written agreement.

You are solely responsible for ensuring that the leads you provide to the Services have consented to be contacted in compliance with applicable law.

7. SMS and Voice Communications

Use of the SMS and voice features of the Services is subject to our Privacy Policy and applicable carrier and regulatory requirements. By using the Services, you represent that you have obtained all necessary consents from individuals who will receive SMS or voice communications through your account. You agree to indemnify PM Solutions Hub against any claims arising from your failure to obtain proper consent.

8. Intellectual Property

All software, content, designs, trademarks, and other intellectual property associated with the Services are owned by PM Solutions Hub or its licensors. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services solely for your own internal business purposes during the term of your subscription. You may not copy, modify, distribute, or create derivative works without our written permission.

You retain ownership of all lead data, call recordings, and business information you provide. You grant us a limited license to use this data to provide and improve the Services.

9. Third-Party Services

Our Services integrate with third-party platforms including but not limited to Twilio (SMS and voice), VAPI (AI voice agents), Google (Sheets and Calendar), Cal.com (booking), and Angi/HomeAdvisor/Thumbtack (lead sources). Your use of these integrated services is subject to their respective terms. We are not responsible for the availability, accuracy, or actions of third-party services.

10. Service Availability and Performance

We strive to keep the Services available 24/7 but do not guarantee uninterrupted operation. Planned maintenance, third-party outages, force majeure events, or technical issues may cause temporary disruption. We are not liable for missed leads, lost revenue, or other damages resulting from service interruptions.

11. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. We do not warrant that the Services will be uninterrupted, error-free, or that any specific number of leads, bookings, or jobs will result from your use of the Services.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PM SOLUTIONS HUB BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless PM Solutions Hub and its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any third-party right, including SMS consent or TCPA requirements; or (d) any content or data you provide to the Services.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-law principles. Any dispute arising under these Terms shall be resolved exclusively in the state or federal courts located in Pennsylvania, and you consent to the personal jurisdiction of those courts.

15. Dispute Resolution

Before filing any legal action, you agree to first contact us in good faith to attempt to resolve the dispute informally by emailing pierce@pmsolutionshub.com with a written description of the issue. We will respond within 30 days. If the dispute cannot be resolved informally, either party may pursue available legal remedies.

16. Modifications to These Terms

We may update these Terms from time to time. Material changes will be posted with an updated "Last updated" date and, where appropriate, notified to active clients by email. Continued use of the Services after changes constitutes acceptance of the revised Terms.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and PM Solutions Hub regarding the Services and supersede any prior agreements.
